The Member Agreement
The Practice Collective was created to foster and support a business community for mental health professionals at 29532 Southfield Rd, Suite 115, Southfield, Michigan, 48076 by providing its members with counseling rooms, space, tables, chairs, trash cans, Internet connectivity, a collaborative community, and other resources and stuff.
By joining The Practice Collective, our members agree to certain rules for our community (“Rules of The Practice Collective,” “Rules”).
The goal of a community such as The Practice Collective is to help each of us have access to private practice support, so we should be considerate of each other, play well together, follow the Rules of The Practice Collective. If one of us doesn’t follow the Rules, it affects all of us and The Practice Collective, and as a condition to membership, we each agree to abide by this Member Agreement (“Member Agreement”).
You are an independent practitioner using The Practice Collective’s space. You are responsible for maintaining your licensure and practicing within your scope. You are responsible for following the MI state board regulations for your profession. If seeing clients, you are also responsible for having your own liability insurance.

Otherwise, here are the Rules of The Practice Collective, which all members, including you, agree to:
1. Conduct
The Practice Collective is, first and foremost, a place to work. Behave well and treat others the way you would want to be treated. Leave any space you use as you found it, or better than how you found it.
At the owner’s discretion, or upon notice from other members, disruptive or abusive language or behavior will result in a warning and a mark against your membership (a “strike”). On the third strike, your membership will be revoked. Your membership may be revoked prior to the third strike upon the sole discretion of the owner.
These are the general rules we ask you to abide by:
1. Indoor voice: We are all trying to get work done, so try to be mindful and respectful of others’ attention and time.
2. Phone calls: If you have a phone call and it will last just a minute or two, feel free to take it in the community room. If you are going to be on the phone for more than that, please use the hallway.
3. Internet: Please be responsible and respectful when using the internet. BitTorent and porn are absolutely not allowed.
4. Harassment: We have ZERO tolerance for harassment of any kind towards members or guests of The Practice Collective. Members or guests violating this policy will be sanctioned or expelled from the space or the event at the discretion of the owner.
5. Guests: Feel free to invite friends or guests for lunch, a quick meeting, or just to say hello. Guests are required to adhere to the Rules of The Practice Collective.
6. Privacy: Please respect the privacy of clients who are coming in for counseling and treat their privacy as if they are your own clients. Do not speak about clients in common areas. Use the sound machines to protect privacy.
7. Client Care: You are responsible for not providing services to clients that are beyond your license or scope.
8. Room Usage: If a room is booked, you cannot use it, even if no one is in there. You must book a room in order to use it. Please clean up after using a counseling room. If you re-arrange the furniture in the room, we expect that you will return it to the original set- up when you’re finished. Please clean the dry erase board too.
9. Fridge: The refrigerator is primarily for storing that day’s food, beverages, and some occasional leftovers from events. As a general policy, food that is older than one week and taking up space will be thrown out. Containers or food left in the refrigerator may be thrown out at any time at the discretion of the owner. Labeling your food with your name and a date will help us at least give you a heads up when it comes time to do a big clean out.
10. Trash and Cleaning: Cleaning services are provided and include daily trash removal and vacuuming on an as needed basis.
11. Supplies: Are we running low on something? Try as we might to keep up with everything, it happens. Send us an email at hello@practice-collective.com.
12. Shared Printer and Shredder: They are for you to use! Please be considerate about the amount of printing you do.
13. Overnight use: We understand that our members may need to pull a late night of work every now and again. However, under no circumstances is sleeping at the space overnight allowed. This is NOT a live/work space. Violating this policy will have your membership revoked immediately.
14. Heat & air conditioning: We set the heat and air conditioning on a schedule that makes sense for most people. Please do not raise or lower the temperature more than 3 degrees. If the heat or air conditioning do not seem to be working, please notify us at hello@practice-collective.com.
15. Furry Friends: As much as we love animals, for the comfort of all of our members, we cannot allow dogs or pets (with the exception service animals) at The Practice Collective without prior permission from us at hello@practice-collective.com.
16. Access Control: The doors are manually and electronically locked. If you believe the doors are not locked after you leave the space, it is your duty to notify us at hello@practice-collective.com. Do not share your personal code with non-members. You are given a code specifically for clients that can be shared with clients. If you are concerned about the a client having access to the space for safety reasons, please notify us at hello@practice-collective.com immediately so we can change the code.
17. Firearms: Members may not, at any time while on any property owned, leased, or controlled by The Practice Collective, including anywhere that The Practice Collective business is conducted possess or use any weapon.
2. Changes
We will do our best to notify members of changes to the Rules and this agreement. We will strive to keep an up-to-date copy of this agreement available.
3. Fees
We collect fees for monthly, quarterly and annual memberships. If you believe you have been billed in error, you should contact us at hello@practice-collective.com before disputing the charge with your card company (issues are usually easy to solve). You are expected to pay for services up front; The Practice Collective cannot maintain a “tab”.
You must cancel your membership at least a month in advance. If your membership renews on May 15th then you would need to cancel on or before April 15th.
You must cancel a room booking at least 24 hours in advance or you will still be charged the fee.
4. Termination
See section 1, “Conduct,” for reference to what actions could lead to termination of your The Practice Collective membership. Beyond those day-to-day rules, you agree not to use The Practice Collective for any purpose that is unlawful, prohibited, or that could damage, disable or impair any part of The Practice Collective, or keep other members from using The Practice Collective, or that would hurt The Practice Collective as an ongoing business. This also means you won’t attempt to gain access to any computer systems or networks of The Practice Collective (beyond general web access), or attempt to obtain any materials or information not intentionally made available to all The Practice Collective members. If you attempt to do any of these bad things, then forget about the three strikes under Rules of The Practice Collective, as your membership may be terminated immediately with notice from the owner.
5. Connections
You also agree not to use The Practice Collective in connection with:
1. Contests, pyramid schemes, chain letters, junk email, spamming or similar annoying behavior;
2. Defaming, abusing, harassing, threatening or otherwise violating the legal rights (such as privacy and publicity) of others;
3. Posting, distributing or disseminating inappropriate, profane, defamatory, obscene, indecent, or unlawful material or information;
4. Uploading, reproducing, using, performing or otherwise making available, images, software or other material or information which infringes another’s rights, or is protected by intellectual property laws where you don’t own or license such rights; and
5. Uploading or using files that contain viruses, corrupted files, or any other similar software or programs.
6. Confidences
You acknowledge that during your membership in The Practice Collective, you are going to be exposed to Confidences. “Confidences” means information (such as business information, trade secrets, technology, customers and prospects, and other secret stuff) disclosed by the owner or by other members of The Practice Collective (including
through your keen observation) that is confidential or proprietary in nature and simply just not known by others. It’s plain and simple – you agree to keep confidential and not to disclose or use Confidences, you understand that they remain the exclusive property of whomever disclosed them, and you don’t acquire any rights to such Confidences.
7. Complaints
Please don’t make defamatory or disparaging comments about The Practice Collective or other members. If something is bothering you, let us know at hello@practice-collective.com.
8. Liability
Neither The Practice Collective nor its members will assume any liability to you with respect to your access to, participation in, use of The Practice Collective, or any loss of information or other property resulting from such participation or use. Basically, if you leave stuff here and it disappears or gets damaged, The Practice Collective is not liable (but we will certainly look into how it happened and work to prevent such losses in future). Although we have liability insurance, The Practice Collective will not assume liability for damages or injuries to clients, guests, or other parties that members may invite to the The Practice Collective space.
9. Health Policy
Do not show up if you are sick. Please wash your hands frequently and clean common spaces after use if necessary. I attest that I will NOT use The Practice Collective LLC coworking facilities (including mail pickup) if:
• I am experiencing any symptom of illness such as cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell.
• I have been diagnosed with Coronavirus/Covid-19 and not yet cleared as non contagious by state or local public health authorities.
• I hereby release and agree to hold The Practice Collective LLC harmless from, and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act of the coworking space, or that may otherwise arise in any way in connection with any services received from The Practice Collective LLC. I understand that this release discharges The Practice Collective LLC from any liability or claim that I, my heirs, or any personal representatives may have against the coworking space with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, any services received from The Practice Collective LLC. This liability waiver and release extends to the coworking space together with all owners, partners, and employees.
10. Disclaimer
1. The Practice Collective PROVIDES space and services “AS IS” AS A SERVICE AND NOT AS A LEASE OF REAL PROPERTY, AND DISCLAIM ALL WARRANTIES AND CONDITIONS, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR USE, TO THE EXTENT PERMITTED BY LAW. THERE IS ALSO NO WARRANTY OF TITLE, QUIET ENJOYMENT OR POSSESSION. THE ENTIRE RISK OF PARTICIPATING IN OR USING The Practice Collective, REMAINS WITH YOU.
2. IN NO EVENT SHALL The Practice Collective OR ITS AGENTS, OWNERS, MEMBERS, OR EMPLOYEES BE LIABLE FOR ANY DIRECT, SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE, CONSEQUENTIAL OR OTHER DAMAGES WHATSOEVER (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOST PROFITS, LOSS OF CONFIDENTIAL OR OTHER INFORMATION, BUSINESS INTERRUPTION, PERSONAL INJURY, LOSS OF PRIVACY, FAILURE TO MEET ANY DUTY (INCLUDING OF GOOD FAITH OR OF REASONABLE CARE), NEGLIGENCE, AND ANY OTHER LOSS) ARISING OUT OF OR IN ANY WAY RELATED TO The Practice Collective OR OTHERWISE, TO THE EXTENT PERMITTED BY LAW.
11. Indemnification
Disclaimer, you also release, and agree to indemnify, defend and save harmless The Practice Collective, its agents, owners, officers, members and employees, from and against all claims, liabilities, losses, damages, expenses, judgments, fines and penalties based on or arising out of your negligent actions, errors and omissions, willful misconduct or fraud, breach or violation of the Rules of The Practice Collective or otherwise suffered in connection with your participation in The Practice Collective or use of The Practice Collective services.
12. Consent
Take note that you can’t assign this Agreement without the prior written consent of The Practice Collective. Since The Practice Collective is situated in the city of Southfield, we all agree that the law of the great State of Michigan governs this Agreement. And we further agree that exclusive jurisdiction and venue for all purposes under this Agreement shall be in Southfield, MI and everybody consents to such jurisdiction and venue. Finally, in the highly unlikely event that any provision or portion of this Agreement is determined to be invalid, illegal or unenforceable for any reason, in whole or in part, the remaining provisions of this Agreement shall be unaffected and shall remain in full force and effect to the fullest extent permitted by law.
I acknowledge that I have read and understood this Agreement and the Rules of The Practice Collective. Further, I agree to be bound by this Agreement and the Rules of The Practice Collective regarding my participation in The Practice Collective and the use of The Practice Collective services.
